SUBJECT OF THE CONTRACT
These General Conditions govern the purchase of products and services made via the Internet on the site “amcouture.it” owned by: AM COUTURE di Antonietta Zito.

The Seller directs the sale of products on his site to two types of customers:
1) Professional B2B customers: artisans, professionals, companies, etc. minutes of regular VAT number. In the case of a professional customer, it is determined a priori that the purchase of the products is for exclusively professional purposes.
2) Consumer: a natural person who acts for purposes not related to any professional activity carried out. The relationship between the Seller and the Customer will be governed by the consumer protection regulations, Legislative Decree of 22 May 1999, n. 185.
The legislative decree excludes subjects classified as professional customers, i.e. those who place an order indicating the VAT number for the invoice.
PRODUCTS The products on the amcouture.it website are handcrafted sartorial creations made entirely by AM COUTURE and third-party companies. The Seller reserves the right to modify the technical information of the products at any time and without prior notice.
PRICES
All prices on the site are intended as prices to the public and, therefore, inclusive of VAT. The Seller reserves the right to change prices at any time, without notice. In the case of products that need to be customized, prices may not be indicated. In this case it will be necessary to contact the Seller directly to make the purchase.
Shipping costs are not included in the purchase price, but are indicated and calculated at the end of the purchase process before payment is made. Any requests for quotes, forwarded via email, do not in any case represent an “executive sales order”.
PRODUCT AVAILABILITY
The availability of the products refers to the one present at the moment in which the Customer consults the product sheets; this must however be considered purely indicative because the AM COUTURE products are produced from 0 by hand at the moment of the order and also that due to the simultaneous presence on the site of multiple users, the products could be sold to others before the order is confirmed. In the event that the products ordered are not in stock (even if available on the site), the customer will be contacted by email or by telephone in order to inform him of the times as all the products are produced from 0 by hand at the moment of the order confirmation. If the customer does not accept the new delivery times, he can cancel the order and the seller will refund immediately or within 10 days. Any delays in crediting may depend on bank transactions or the type of credit card.
PURCHASE METHODS Before confirming the purchase, the Customer will be shown a summary of the unit cost of each chosen product, the taxable amount, the shipping costs and the total cost. By confirming the purchase, the Customer will be able to print the data of his order and will automatically receive by email the summary of the registered order containing the details of the Customer and the order, the price of the goods purchased, the transport costs and the shipping address to which the goods will be sent. The customer undertakes to verify the correctness of the data contained therein and to promptly communicate any corrections.
The validation of the order is intended only if the Seller confirms the shipment of the goods. The advance payment of a supply does not justify a confirmation of acceptance of the order, it may be refused by the house and refunded minus the costs of return banking operations.
ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE AND CUSTOMER OBLIGATIONS
Before confirming his purchase order, the Customer is invited via a link to read these General Conditions of Sale and then to tick the acceptance box. Failure to accept will prevent the completion of the purchase procedure. By completing the order, he thus tacitly declares to fully accept these General Conditions of Sale and undertakes to observe them in his/her relations with the Seller. Furthermore, the Customer undertakes to print and keep these general conditions of sale, already viewed and accepted during the purchase process carried out.
PAYMENTS Payment for the purchased products and the related shipping costs must be made by the customer using the following methods: PAY PAL, BANK TRANSFER.
Through the secure PAY PAL circuit (http://www.paypal.com/) you can pay with any credit card, just open a free account in a few simple clicks. At no time during the purchase procedure will the Seller be able to know the information relating to the Customer's credit card, as they will be managed directly by PAY PAL, using very high security systems; as there is no data transmission, there is no possibility that this data will be intercepted.
If the BANK TRANSFER option is chosen, the available goods will be shipped only after the payment has been credited, which must be done within a maximum of 5 working days, otherwise the order will be cancelled. The reason for the bank transfer must indicate: the order number and date, the company name or name of the buyer; the coordinates will be visible when the payment by Bank Transfer is selected and will also be shown in the order confirmation email automatically sent to the customer.
By accepting these General Conditions, the Customer expressly consents to the invoice being sent to him in paper format inside the package with the goods.

COLLECT IN SHOWROOM
By specifying in the order that the products be collected at the Headquarters, the Customer will be able to collect them directly at the AM Couture showroom, in via La Spezia, 90, CUBO A, floor 04, 43125 Parma, by making a telephone appointment upon order confirmation.
RIGHT OF WITHDRAWAL AND CONDITIONS FOR ACCEPTANCE OF RETURNS. The customer, if he can be classified as a "consumer" and referring to the Legislative Decree of 22 May 1999, n. 185, can avail himself of the right of withdrawal within the deadline of 10 working days from receipt of the goods.
To exercise your right to use the return option on the MY ACCOUNT > ORDERS page, select your order and click on the return button.
The Customer must return the material intact, complete with any accessories and the tax documentation received with the item itself, under penalty of forfeiture of the right of withdrawal.
The right of withdrawal lapses entirely, due to the lack of the essential condition of integrity of the goods (packaging and/or its contents), in cases where the Seller ascertains: • the lack of the external packaging and/or the original internal packaging; • the absence of integral elements of the product (accessories or other parts) or anomalies in the product itself; • damage to the product for reasons other than its transport.
By law, the shipping costs and risks related to the return of the goods are the responsibility of the Customer. Upon receipt of the product by the Seller and verification of its condition, the amount will be refunded by bank transfer to the account indicated by the customer or via PAYPAL within 30 days. The Seller will not refund until the return costs have already been paid in full by the customer.

The Seller also guarantees Professionals the possibility of withdrawing within 10 days of receiving the Product with the return methods set out in the previous article. In the event of withdrawal, the Professional will be reimbursed only for the cost of the Product, excluding any other costs incurred for the preparation or delivery of the Product. The costs of returning the Product are borne by the Professional.
RESPONSIBILITY
The Seller assumes no responsibility for disruptions attributable to force majeure or unforeseeable circumstances, even if dependent on malfunctions and disruptions of the Internet network, in the event that it is unable to execute the order within the timeframes set out in the contract.
JURISDICTION AND APPLICABLE LAW
The sales contract between the Customer and the Seller is deemed to be concluded in Italy and governed by Italian Law. For the resolution of civil and criminal disputes arising from the conclusion of this distance selling contract, if the Customer is a consumer, the territorial jurisdiction is that of the reference court of his/her municipality of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of Parma.
